D is for Doggy 10th Ave Services Agreement

Please read carefully. This agreement includes a release of liability and waiver of the right to sue 10th Ave NYC Inc. DBA D is for Doggy. By signing this agreement you acknowledge you are capable of understanding and consenting to the terms of this agreement and understand and consent to the terms herein. You further acknowledge that you have the right to seek advice of legal counsel if you are unsure of the effect of this agreement. Your signature below reflects that you have consulted with legal counsel or, alternatively, you’re knowing, willing and express waiver of right to seek the assistance of legal counsel before entering into this agreement.

This agreement is between 10th Ave NYC Inc. DBA D is for Doggy, a New York Corporation, and the Owner whose name and signature appears on this agreement, herein referred to as “Owner”. In consideration for my dog (hereinafter referred to as the “Pet”) being permitted to attend D is for Doggy for daycare, boarding, training and/or grooming services, I make the following representations and agree to all of the following policies, procedures, terms and conditions.

I verify the accuracy of all information about my Pet submitted to D is for Doggy. This information includes, but is not limited to, medical documents from the Pet’s veterinarian, medical history, up-to-date vaccination records, and overall temperament and behavior issues and evaluations.

I understand that the D is for Doggy staff are not licensed in the area of animal medicine or veterinary care, and therefore cannot examine, diagnose, or treat illnesses in my Pet. I acknowledge that vaccines do not guarantee protection from transmittable diseases, and I assume the risk of any and all illness or harm to my Pet by allowing my Pet to attend D is for Doggy. As set forth more fully in paragraph 3, I waive any and all claims against and release D is for Doggy from any resulting harm to my Pet.

Waiver, Release, and Indemnification:

(a) I acknowledge that my Pet may incur injuries, illness, disease, or harm while in the company of other dogs at D is for Doggy. While D is for Doggy encourages interaction and play between dogs, I am aware that risks and hazards may arise while my Pet is under D is for Doggy’s care. I hereby expressly and forever release 10th Ave NYC Inc. DBA D is for Doggy, its owners, agents and/or employees, (the Releases) from any and all liability, claims, litigation, actions, suits, costs, losses, damages, expenses, or demands (including reasonable attorney’s fees) of every character whatsoever on account of, resulting from or relating in any way to (i) any act or omission of the Releases; and (ii) my or my Pet’s participation in activities at D is for Doggy, or otherwise.

(b) I waive any and all potential claims against 10th Ave NYC Inc. DBA D is for Doggy, its owners, agents and/or employees and agree to indemnify and hold harmless the Releases against any claims (including those for attorney’s fees) made against them due to the actions of my Pet while in the care of D is for Doggy.

(c) I agree that this release shall be binding on me and my successors, heirs, legal representatives, and assigns. I agree to indemnify 10th Ave NYC Inc. DBA D is for Doggy against any costs, damages, or expenses (including veterinary or medical fees) that may result from an injury or illness to my Pet.

(e) In the event that my dog causes injury or death to another dog or to a person while in the care of or on the grounds of 10th Ave NYC Inc. DBA D is for Doggy, I indemnify and hold harmless 10th Ave NYC Inc. DBA D is for Doggy from any action which may be brought against it and for any defense, settlement or judgment entered against it resulting from such action of my dog. I also agree that if my dog causes injury to another dog or to a person while in the care of and/or the grounds of 10th Ave NYC Inc. DBA D is for Doggy, I agree to pay the veterinary and/or medical expenses of the injured dog and/or person and I assume all liability for the actions of my dog.

I acknowledge and accept the fact that D is for Doggy categorizes dogs in playgroups consisting of dogs that have similar temperament, behavior, play style, and similar stage of canine development. These playgroups are assembled at the sole discretion and expertise of D is for Doggy staff members. I further acknowledge that the composition of these playgroups may change at any point without my consent. I further understand that my Pet may incur minor scratches or cuts while playing with other dogs and that D is for Doggy may temporarily separate my Pet from a playgroup at the staff’s discretion in order to ensure the safety of the other dogs.

In the event my Pet is injured or sick, D is for Doggy will bring my Pet to the specified veterinarian office identified in my Pet’s registration form. If my Pet’s veterinarian is unavailable, I authorize D is for Doggy to bring my Pet to another veterinarian chosen by the staff at D is for Doggy. I further grant D is for Doggy access to my Pet’s full medical history and files in order to provide the most thorough medical care for my Pet.

I agree to pay 10th Ave NYC Inc. DBA D is for Doggy for all services rendered at the rate of the check out day for my Pet. I authorize 10th Ave NYC Inc. DBA D is for Doggy to charge the credit card on file for services rendered at the time of the transaction. I also authorize D is for Doggy to charge the credit card on file for reoccurring services, i.e. renewing daycare packages, over the phone or in person orally.

All dogs enlisted in any of our services must be picked up during hours of operation. The night time personnel are not authorized to release a dog after D is for Doggy closes. 10th Ave NYC Inc.

DBA D is for Doggy is not responsible for loss or damage to any of my Pet’s belongings.

No Refunds. Store credit only. 10th Ave NYC Inc. DBA D is for Doggy services are non-refundable.
